US Appeals Judge Raymond Lohier has just bowed down to Der Führer, knocking down the temporary injuction against Obama’s indefinite military detention provision until the appeals court hears the case September 28th. This comes after Obama’s legal team REFUSED TO ADMIT TO THE COURT WHETHER THE OBAMA ADMINISTRATION HAD BEEN ILLEGALLY BREAKING THE TEMPORARY INJUNCTION against indefinite detention set by Judge Forrest this spring!!
This means the Obama team can indefinitely imprison any American for any thought crime over the next 10 days until the appeals court rubber stamps permanent indefinite detention.
A lone appeals judge bowed down to the Obama administration late Monday and reauthorized the White House’s ability to indefinitely detain American citizens without charge or due process.
Last week, a federal judge ruled that an temporary injunction on section 1021 of the National Defense Authorization Act for Fiscal Year 2012 must be made permanent, essentially barring the White House from ever enforcing a clause in the NDAA that can let them put any US citizen behind bars indefinitely over mere allegations of terrorist associations. On Monday, the US Justice Department asked for an emergency stay on that order, and hours later US Court of Appeals for the Second Circuit Judge Raymond Lohier agreed to intervene and place a hold on the injunction.
The stay will remain in effect until at least September 28, when a three-judge appeals court panel is expected to begin addressing the issue.
On December 31, 2011, US President Barack Obama signed the NDAA into law, even though he insisted on accompanying that authorization with a statement explaining his hesitance to essentially eliminate habeas corpus for the American people.
“The fact that I support this bill as a whole does not mean I agree with everything in it,” President Obama wrote. “In particular, I have signed this bill despite having serious reservations with certain provisions that regulate the detention, interrogation, and prosecution of suspected terrorists.”
A lawsuit against the administration was filed shortly thereafter on behalf of Pulitzer Prize-winning journalist Chris Hedges and others, and Judge Forrest agreed with them in district court last week after months of debate. With the stay issued on Monday night, however, that justice’s decision has been destroyed.
With only Judge Lohier’s single ruling on Monday, the federal government has been once again granted the go ahead to imprison any person “who was part of or substantially supported al-Qaeda, the Taliban or associated forces that are engaged in hostilities against the United States or its coalition partners” until a poorly defined deadline described as merely “the end of the hostilities.” The ruling comes despite Judge Forrest’s earlier decision that the NDAA fails to “pass constitutional muster” and that the legislation contained elements that had a “chilling impact on First Amendment rights”

There really should be a coalition formed among groups like the CATO Institute, Judicial Watch, the ACLU, the Lawyers Guild and others in order to fight the police state, and the battle ground should be the media and in the front of courthouses as well as courtrooms.
I know people within these organizations and I’m going to plant some seeds. Others that have contacts should do the same – or write letters to these organizations and others.

I thought this was an executive order, and that the Moron in chief has everything to do with creating it. He should take out the onerous parts if he has objections instead of his false whining bullshit.
If he did not agree with everything in this bill, then why didn’t that spineless jellyfish insist on modifying it before signing it? So what if the bill would’ve had to go through the approval process again.
As an Engineer, I will only sign off on a drawing if I agree with its content, and if I determine that it needs to be revised, then it will have to be revised before I approve it.
And I don’t give a sh!t if it is only a drawing for a bolt – if I do not agree with what i am approving then I simply won’t do it. How much more important is it to sign off only what you approve, when you are the leader of the ‘Free World’ and what you are approving affects individual freedoms?

Some unfortunate facts to add to the hyperbolic rhetoric…
. The NDAA bill (including the detention clause) was introduced by the Republican Congressman Howard Mckeon.
. The clause was introduced to replace the Authorization for Use of Military Force Act (AUMF, a joint resolution passed by Congress in September 2001, gave congressional approval for those detentions) to give congressional control to the detention powers (mostly unlimited) that the Bush administration had since 911.
. The NDAA bill was passed Dec 2011 in the Senate 86-13 (6Ds and 6Rs voted no), and 283-136 (190Rs-93Ds voted yes… including Cantor, Ryan, King, Joe “you lie” Wilson, IIsa, etc) in the House.
So, it seems the real “Der Führer” was actually John Boehner (as Speaker he rarely votes but clearly supported and moved the bill through the House twice)… but then that wouldn’t play well on Fox News so “what to do”… Oh I know, just blame it on Obama, the sheep will believe anything we say about him!

How about we organize all the constitutional lawyers, Judicial Watch, the Southern Lawyers association and completely burn their books in front of these corrupt court rooms nation-wide like they deserve. That means shred the legal fake blue book they are using in courts across the country, put it on T.V. camera, and awaken at least five million more Americans. Throw the pile of dirt on these corrupt courts which protect the Federal Reserve, out them as communists & flush ‘em out.
